1. GENERAL PROVISIONS

1.1. These General Terms constitute a binding agreement between PAWMATIX DPK (hereinafter "The Company") and the Users, governing the relationship arising in connection with the system for utilizing promotions, discounts, and special offers at Participating Merchants (hereinafter "The Program").

1.2. Participation in the Program is conditional upon the acceptance of these General Terms. Participation is impossible without explicit agreement to these Terms and the Privacy Policy. Users may review these documents at any time on the website.

1.3. A Participant in the Program may only be a natural person who is at least 18 years of age on the date of submitting the application.

1.4. Every User may benefit from the Program by purchasing a PAWMATIX Loyalty Card. By purchasing the Card, the User accepts and undertakes to observe these General Terms.

1.5. A valid PAWMATIX Loyalty Card is defined as one that:

·         Is issued by PAWMATIX DPK.

·         Has designated integrity (if physical) or valid digital credentials.

·         Contains legible text/data and a unique identification number.

·         Is presented at the Participating Merchant's location within its validity period.

1.6. The Card serves to identify the Participant before Participating Merchants (and their staff) and to certify the right to use the promotions and special offers included in the Program.

1.7. The Company reserves the right to amend, supplement, cancel, or terminate these General Terms and the services/goods to which they relate, subject to applicable legislation. Updated terms will be published on the website.

2. CARDHOLDER, COMPANIONS, AND VALIDITY

2.1. The Card is not issued for a specific monetary value. It is not a bank card, credit card, or payment instrument.

2.2. The Card is personal (named). The Cardholder is the person whose name is inscribed on/in the card. The persons designated as Companions of the pet enjoy the same usage rights as the Cardholder.

2.3. Current promotions and special offers are published on the PAWMATIX website.

2.4. Validity: The Card is valid for 12 (twelve) months, calculated from the date of purchase from PAWMATIX.

2.5. The validity period cannot be modified.

2.6. The Card cannot be exchanged for cash, used as collateral, or provided as a guarantee.

2.7. Each client may possess only one active card.

2.8. The Card cannot belong to more than one titular Cardholder. 2.9. Participating Merchants (and their staff) have the right to inspect, verify, accept, or refuse the Card as a document certifying the right to discounts/benefits.

3. ISSUANCE OF THE CARD

3.1. The Card is acquired against payment.

3.2. The User orders the Card by completing a standard Application Form, accepting these General Terms, and acknowledging the Privacy Policy.

3.3. Companions: In the application, the User has the right to designate up to four (4) Companions who are authorized to use the Card for the registered pet.

3.4. Users receive their cards via courier to the address specified in the application (or via digital delivery if applicable).

4. USE OF THE CARD

4.1. The Cardholder undertakes to use the Card only personally or through the designated Companions.

4.2. Upon presenting the Card, the holder is entitled to use specific promotions/offers. The Cardholder must observe the internal rules of the Merchant's facility.

4.3. Verification Procedure: The Card must be presented at the Merchant's facility along with a valid ID document. The Merchant has the right to require the presentation of the Pet Passport. The Merchant may refuse service if the data of the Cardholder or Companions does not match the ID document and/or the owner data listed in the Pet Passport. 

4.4. Merchant staff may verify identity and compare data between the Card, ID, and Pet Passport. Service may be refused in case of discrepancy. 

4.5. The Card may be used repeatedly until its expiration.

4.6. The Cardholder may check the remaining number of available promotions/uses by logging into their profile on the website.

4.7. The Card allows use only at Participating Merchants included in the Program. 4.8. Only one card may be used per single service or purchase.

4.9. Availability Disclaimer: The Card does not guarantee the perpetual availability of goods/services from specific Merchants that were available at the time of purchase. PAWMATIX reserves the right to change the list of Participating Merchants and their offers unilaterally. Changes are effective upon publication on the website.

4.10. Reissuance: Reissuing the card due to loss, theft, damage, or data correction is a paid service. The old card becomes invalid.

4.11. Blocking: PAWMATIX may block a card at any time if there is evidence of bad faith or usage untypical for personal needs.

4.12. The Cardholder may not sell or rent the card to third parties.

5. LIMITATION OF LIABILITY

5.1. PAWMATIX is not liable for lost, stolen, or damaged cards after delivery.

5.2. PAWMATIX does not check for the bona fide acquisition of the card unless required by law.

5.3. Service Quality: PAWMATIX is not liable for the quality, safety, or timeliness of goods and services provided by external Participating Merchants.

5.4. PAWMATIX is not liable if a Merchant fails to fulfill an offer or if goods are out of stock.

5.5. The Cardholder is responsible for all damages resulting from misuse or falsification of the card.

5.6. Technical Issues: If the card cannot be read/processed by a Merchant due to technical reasons (e.g., terminal failure), PAWMATIX is not liable for the inability to use the discount.

6. RIGHT OF WITHDRAWAL

6.1. The User has the right to withdraw from the contract within 14 days of receiving the card, without compensation or penalty, using the Standard Withdrawal Form available on the website (Appendix No. 1).

6.2. Refund: Upon exercising this right, PAWMATIX will refund all sums received, including delivery costs, within 14 days of notification. Refunds are made using the original payment method unless otherwise agreed.

6.3. Return Costs: The direct cost of returning the card is borne by the User and may be deducted from the refund. The User is obligated to return the PAWMATIX Loyalty Card.

7. AMENDMENT AND TERMINATION

7.1. PAWMATIX may unilaterally amend these Terms by publishing updates on the website. 7.2. PAWMATIX may terminate the Program at any time by notifying Cardholders at least 30 (thirty) days in advance via the website.

8. GOVERNING LAW AND DISPUTES

8.1. These Terms are governed by Bulgarian legislation. Disputes shall be resolved through negotiation; if unsuccessful, the dispute shall be referred to the competent Bulgarian court.

9. PERSONAL DATA (GDPR)

9.1. By using the Card, the Cardholder consents to their personal data being processed by PAWMATIX and provided to third parties (Participating Merchants) strictly necessary to provide the Program's benefits. 9.2. Full details on data processing rights are available in the Privacy Policy provided upon application and available on the website.

DEFINITIONS

·         PAWMATIX Loyalty Card: A digital or physical document with a specific validity period, issued by PAWMATIX, used for Cardholder identification.

·         Participant/User: A natural person (Cardholder or Companion) utilizing the card for promotions.

·         Cardholder: The physical person in whose name the card is issued.

·         Companion: A physical person explicitly designated by the Cardholder with the right to use the card for the registered pet.

·         Validity Period: Twelve months from the date of purchase.

·         Participating Merchant: A physical or legal person providing promotions/offers upon presentation of the card.

·         Commercial Site: The physical or digital location where the Merchant offers goods/services.

Note: The User has the right to withdraw within 14 days without penalty. The card must be returned to the merchant.
